In this memorandum opinion, the court considers the motion for summary judgment filed by defendant Arby’s Restaurant Group Inc. (“Arby’s” or “defendant”) pursuant to Rule 56(c) of the Federal Rules of Civil Procedure. (Doc. No. 22.) Defendant seeks summary judgment in its favor with respect to all claims asserted by plaintiff Joedi Mascioli (“plaintiff’ or “Mascioli”).
