MEMORANDUM AND ORDER

WALKER, District Judge:

Plaintiff brings this action against Louis Sullivan, the Secretary of Health and Human Services (“the Secretary”), 1 under 42 U.S.C. § 405(g) of the Social Security Act (“the Act”) to review a final decision denying payment for a medical procedure under the Supplementary Medical Insurance Benefits for the Aged and Disabled Program (“Medicare Part B”). The Secretary has moved to dismiss this complaint for lack of subject matter jurisdiction, pursuant to Fed.R.Civ.P. 12(b)(1) and, alternatively, has requested a judgment on the pleadings.
