OPINION

SCHUMACHER, Judge.

This appeal is from judgments of conviction and sentences for theft by false representation. Minn.Stat. § 609.52, subd. 2(3) (1990); see also Minn.Stat. § 609.52, subd. 3(5) (1990). We affirm in part, reverse in part and remand.

FACTS

Appellants were charged with theft by false representation for billing insurers— Medicare, Medicaid and Blue Cross Blue Shield — for basic life support (BLS) ambulance service for transporting kidney dialysis patients to and from dialysis.
