Plaintiff sold 40 acres of land to defendants Emma Johnson and John F. Johnson, husband and wife. The Johnsons, on March 1, 1920, executed to plaintiff note and purchase-money mortgage for $16,000, due March 1, 1930, with interest payable annually. The mortgage was a first lien on the 40 acres. Plaintiff assigned and delivered the note and mortgage to Westphalen, as collateral .security for money borrowed of Westphalen, aggregating, at time of decree, $7,240.26.
