MEMORANDUM OPINION AND ORDER

KANE, District Judge.

BACKGROUND

The history behind this action is described in my earlier opinion and order issued on March 30, 1987. In a predecessor controversy tried in this court, 645 F.Supp. 254 (Staats I), Staats brought suit against Pioneer Uravan, Inc. (PUI) for breach of a mining contract. During the course of the trial, third-party defendants Pioneer Corporation (PC) and Pioneer Nuclear, Inc. (PNI) were dismissed from the case. The jury ultimately returned a verdict in favor of Staats. Staats subsequently filed a motion for a new trial on its claims…
