This is a petition brought by The Merchants National Bank of New Bedford, trustee under the will of Charles C. Church, for instructions as to the proper construction of the phrase “heirs of my said children,” which appears in the residuary clause of the will. The will was executed on April 23, 1903. At that time the immediate family of the testator consisted of his wife, Aroline, and two children, Cordelia W. and Charles B. Cordelia W. was unmarried.
