Appellee sued appellant in the justice court of Grayson county for $122.-65, for damages for injury to a transit caused by the alleged negligence of appellant’s servant, Fred Montgomery, in driving a wagon against the instrument, where it stood in the center of one of the streets of Denison, placed there by an assistant of appellee, Fred Bennett, in the performance of his duty of establishing the grade of the street for the city of Denison.
