MEMORANDUM OPINION AND ORDER

Pending is defendant’s motion for summary judgment, filed December 29, 2011.1 *814For the reasons set forth below, defendant’s motion is granted in part and denied in part.
I. Background
This action, brought pursuant to the West Virginia Consumer Credit and Protection Act (‘WVCCPA”), W. Va.Code §§ 46A-1-101 et seq., arises out of a consumer loan made to plaintiffs James Ferrell and Nina Ferrell for the purchase of an automobile.
