Petitioner, the trustee under an indenture of trust dated July 29,1935, made by one Alexander R. Nicol, instituted this proceeding, pursuant to article 79 of the Civil Practice Act, for the judicial construction of said trust indenture and for the judicial settlement of the intermediate *900account of the proceedings of said petitioner. Upon the return, several issues were raised requiring inquiry as to the intent of the settlor at the time he executed the trust indenture.
