Burwell, J.:

The defendant was indicted, tried, convicted, and sentenced to serve a term of fifteen years in the territorial penitentiary for the crime of rape. He now prays a reversal of the judgment and sentence of the trial court, .and insists that he is entitled to a new ■trial on account of certain prejudicial errors which he claims were committed during tbe trial of his case.

The indictment, omitting the caption and indorse-ments, is as follows:

“The grand jurors of the Territory of Oklahoma, inquiring in and for the body of Logan county, duly impaneled and sworn,…
