Defendant was convicted in the Municipal Court of Cincinnati of a misdemeanor under city ordinance of operating an automobile while under the influence of alcohol.

The narrative bill of exceptions shows positively by the police officer’s own testimony that he arrested defendant in front of his home without a warrant and without personally having seen defendant operating his car in violation of any eity ordinance.

Defendant’s timely motion to suppress the evidence and quash the affidavit, for the reason that the offense charged was a misdemeanor not committed within the view of the arresting…
