ORDER
CARRIGAN, District Judge.
Petitioner Douglas Rubins, an inmate incarcerated at the Territorial Correctional Facility in Canon City, Colorado, has filed this action pursuant to 42 U.S.C. § 1985(3) alleging violations of his Eighth Amendment right to be free from cruel and unusual punishment. This case was assigned to Magistrate Abram who reviewed the matter and prepared a recommendation pursuant to Local Rule 605.
