MEMORANDUM OPINION AND ORDER

MORAN, Senior District Judge.

Plaintiff has two patents, U.S. Patent Nos. 6,766,304 (the ’304 patent), and 6,772,-132 (the ’132 patent). Both relate to a software program for use in electronic trading in futures. The software program combines a static ladder price column with moving bid and asked market data, together with a single-action order entry. Defendant came into the market with its own software program. It does not argue that its first program is non-infringing.
