In Rauschenberger v. Radetsky, 712 P.2d 1089 (Colo.App.1985), the Court of Appeals affirmed the trial court’s entry of summary judgment in favor of the respondent, Dr. Paul Radetsky, in a wrongful death action brought by the petitioners, Gerald A. Rauschenberger and Terry Raus-chenberger, sons and heirs of the decedent, Elton H.
