ORDER ON DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

GRITZNER, District Judge.

This matter is before the Court on Defendant’s Motion for Summary Judgment (Clerk’s No. 17). This motion seeks dismissal of all counts alleged in Plaintiffs Complaint. Attorney for the Plaintiff is Mark Sherinian; attorneys for the Defendant are Elizabeth Gregg Kennedy and Nathan J. Overberg. An oral hearing was held on the motion on Friday, May 28, 2004.
