Plaintiff brought suit against his employer to recover a specified amount of wages which he alleged he would have earned and received had not the employer violated plaintiff’s seniority rights created and established by the labor relations agreement governing his employment by the defendant. The cause was tried to the court without a jury. Upon the conclusion of the evidence, the court took the matter under advisement and thereafter rendered a memorandum decision dismissing the action without prejudice.
