This case comes before us on appeal of the Government from the decision of the trial judge in reappraisement. Gehrig, Hoban & Co., Inc. v. United States, 54 Cust. Ct. 538, Reap. Dec. 10909. Appellant’s allegations of error present for our decision two principal issues, both of which have to do with the rules of evidence applicable to the case. The first issue is whether the trial judge erred in excluding from evidence certain reports, called customs agent reports, offered by appellant (defendant below).
