Plaintiff in error, C. L. Shafer, complains of the action of the common pleas court in overruling a motion and a demurrer to defendant in error’s second amended petition and in entering judgment thereon. Defendant in error was the plaintiff below and the plaintiff in error was the defend ant, and they will be so referred to in this opinion.
