GEWIN, Circuit Judge:
David Marder appeals from his conviction for using a wire communication facility to transmit wagering information in interstate commerce while being engaged in the gambling business in violation of 18 U.S.C. § 1084. 1 He was convicted on September 30, 1971 on three counts of violating the statute and sentenced to eight months imprisonment under each count and fined $5,000.
