MULLEN, District Judge:
Appellant Norris Shealy appeals from the decisions of the district court dismissing his complaint. Shealy asserts that the district court erred in granting summary judgment for appellees against the first count in his complaint, which alleges violations of the Age Discrimination in Employment Act, 29 U.S.C. §§ 621, et seq., and the Fair Labor Standards Act, 29 U.S.C. §§ 201, et seq.
