The plaintiffs in error were at the May term., 1897, of the circuit court of Williamson county, adjudged guilty of embezzlement under the act approved June 4, 1879, entitled “An act for the protection of bank depositors,” and condemned to pay a fine of 8410 and to be imprisoned in the penitentiary for the term of one year. The provision of the statute under which the conviction was had is as follows: “That if any banker or broker, or person or persons doing a banking- business, or any officer of any banking- company or incorporated bank doing business in this State, shall receive from any…
