This action of trespass on the case for negligence was tried to a jury in the superior court. At the conclusion of the plaintiff’s evidence the defendant rested and moved for a directed verdict which was denied. Thereafter the jury returned a verdict for the plaintiff and the defendant moved for a new trial which was also denied. It duly excepted to each denial and also to a portion of the trial justice’s charge to the jury.
