This matter is before .the Court on the motion of defendant Priority Business Forms, Inc. (“Priority”) for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. The case arises out of a burglary and arson committed at property owned by Carol Pearl, Inc. (“Carol Pearl”), insured by plaintiff The Travelers Insurance Co. (“Travelers”), and leased to Priority. Travelers, as subrogee of Carol Pearl, blames Priority for the damage to the property, and seeks to recover from Priority the amounts paid to Carol Pearl under the applicable…
