Thompson was convicted of the offense of cheating and swindling. The indictment was in three counts. We set forth one of the counts as representative of each of the three. It was charged in count 1, with omission of the formal parts, as follows: “The grand jurors . . charge and accuse Clarence J. Thompson with the offense of misdemeanor (defrauding the City of Atlanta) for that the said accused, in the County of Fulton and State of Georgia, on the 1st day of November, 1940, . . being then and there an inspector, employed by the City of Atlanta, in the waterworks…
