Wilbur LaRue Boyce, Jr., brings this appeal from his conviction and sentence of theft by taking. Defendant, an attorney, was charged with unlawfully appropriating money belonging to a client. He enumerates seventeen errors.

In his first enumeration defendant asserts that the trial court erred in not allowing evidence of the dismissal of charges against him at the preliminary hearing. “A dismissal of charges based upon lack of probable cause does not bar the subsequent indictment and trial of a defendant on the same charges.
