The question involved is whether under section 23 of the Personal Property Law the trust of personal property created by plaintiff on January 31, 1934, has been validly revoked by him.

Under date of January 31, 1934, plaintiff, a resident of the State of New York, of full age and then married to Margaret V. Engel, executed a trust agreement with defendant Guaranty Trust Company of New York, under the terms of which he delivered to defendant certain personal property in trust.
