These eases were heard together, and may be so considered and determined, as the principal questions involved are common to them both. In that of the Cosmos Exploration Company the lands involved constitute the fractional W. ½ of section 30, in township 28 S., range 28 E., Mt. Diablo base and meridian; and the E. ½, of the S. W. ¼ of section 4, in township 29 S., range 28 E., same base and meridian, constitutes the property in controversy in the case brought by the Pacific Land & Improvement Company.
