ORDER DENYING MOTION TO DISMISS
HIGBY, District Judge.
This case is before me on Defendants’ motion to dismiss the second amended complaint. Wong’s complaint alleges the Defendants discriminated against him on the basis of his race and national origin and denied him due process in discharging him from his position as a Professional Engineer II in the Bureau of Mobile Home Construction, Department of Highway Safety and Motor Vehicles, State of Florida (hereinafter the Bureau and the Department, respectively).
