This was an action to recover money deposited with the defendant by the plaintiff as a stakeholder, on a wager depending on the result of the presidential election in the state of Pennsylvania; and among other things it is alleged that the respondent, at various times thereafter, and particularly on the 6th day of November and on the 30th day of November, 1880, at Roseburg, demanded of the appellant the money so deposited, but that appellant refused to return the same to the respondent, and that no part of the same has been paid.
