The real question on the trial of this action was whether the indorsement of the court commissioner upon the copy of the assignment which was filed in the office of the clerk of the court on January 9, 1888, was placed thereon at the time it was filed, on said 9th of January, or whether it was placed thereon after said date, and after all the attachments were levied upon the property in question.
