Action to foreclose a subcontractor’s hen on work done in connection with the erection of a building for the Department of Mental Hygiene of the State of New York. According to the last certificate of the State Architect, the general contractor had executed approximately ninety-one per cent of the work required by the contract when he defaulted. The defendant surety company, pursuant to the contractor’s bond, thereupon completed the work at the request of the State.
