Official Referee. This action is one for the foreclosure of a mechanic’s lien on a fund in the hands of the State growing out of the erection of a State armory at Jamestown, N. Y.

The fund subject to distribution is $14,970.09.

The defendant The Longacre Engineering and Construction Company, Inc., was the general contractor with the State for the *19erection of the armory in question. It completed its contract and the State has accepted the work. The Longacre Company, however, became financially involved, which has resulted in the filing of numerous liens against the fund in the…
