— Reversing.

It was tlie night before Christmas, 1906, that marked the tragedy giving rise to the present prosecution, and in which appellant took the leading role. The .scene was staged at a barber shop in Corbin. The setting as depicted by counsel for appellant may be thus summarized :

Having closed his shop for the night and 3'ust after he got outside, appellant met two men who asked to go *225into the shop to get warm. About the same time three little girls, thinly clad and shivering, chanced that way and asked permission to go inside for a like purpose.…
