Affirming.
The appellant, TIardin Banks, was tke defendant in an indictment found by tke grand jury of McCracken county accusing kim of tke crime of malicious- skooting and wounding of anotker witk intent to kill, and upon kis trial tkereunder tke jury returned a verdict of guilty and fixed kis puniskment at confinement in tke penitentiary for a term-of five years, upon wkick judgment was pronounced, and to reverse it defendant prosecuted tkis appeal.
