This is an action for patent infringement arising under the Drug Price Competition and Patent Term Restoration Act of 1984 (the “Hatch-Waxman Act”). 1 Plaintiff Aventis Pharma Deutschland GmbH (“Aventis”) owns two unexpired patents relating to the ACE inhibitor “ramipril,” a drug approved by the FDA to treat hypertension, heart failure, and to reduce the risk of heart attack, stroke, and death from cardiovascular causes.
