Error to the Court of Civil Appeals for the Third District, in an appeal from Lampasas County. Jackson & Edwards sued the railway and recovered judgment. Defendant appealed and on affirmance obtained writ of error.

BROWN, Associate Justice.

Jackson and Edwards sued the railroad company to recover damages for breach of a contract in the shipment of cattle from Lampasas to Halls and Sapulpa, Indian Territory. Upon trial the jury returned a verdict for $4,000 damages. From the statement made by the Court of Civil Appeals we condense the following as the facts found by that court:
