Appellee and plaintiff below, Domenico Marcucilli, owns a dwelling house and lot on the west side of Second street in the city of Louisville, Kentucky, between York and Breckinridge streets, which was formerly owned by Judge C. B. Seymour. Adjoining plaintiff’s lot on the south side is one owned by appellant and defendant below, William H. Emrich, which was formerly the old Powhattan Woolridge residence.
