LINCOLN, Justice.

This is an appeal from a judgment of the District Court of Smith County in a *799receivership proceeding of a business owned and operated by T. J. Conway as T. J. Conway Drilling Company. The record is voluminous, the parties are numerous, and the facts are complicated. We will state the case as briefly as possible as they relate to the issues.

The original petition filed July 2, 1948, alleged an indebtedness of Conway to various persons in excess of $200,000.00, and on the same date W. A. Pounds was appointed and qualified as Receiver.
