*643This was a proceeding by notice of motion instituted in the circuit court by the plaintiff in error against James Hale, Zed Hale and Elbert Pressley, trading as partners under the style and firm name of Hale & Pressley, to recover judgment upon an open account of merchandise sold the firm, amounting to the sum of $651.17.
