This was an action at law, brought in the Circuit Court of the United States for the Eastern District of Michigan,-in August, 1886, by Isaac S. Hobbie and John A. Hobbie. The original defendants wére Charles E. Jennison and Isaac H. Hill. ■ As a result of the findings of fact, the Circuit Court held that the sale and delivery of the pipe by .the defendant were made at Bay City, Michigan, but that, in view of the decision of this court in Adams v. Burke, 17 Wall. 453, the defendant could not be held as an infringer by reason of his knowledge that the pipe was to be used in a territory of which the plaintiffs held the monopoly.
