This is a workmen’s compensation suit. Frank Arnell Hinkle, the employee, was killed on January 24, 1940. He was survived by four brothers and two sisters, all adults. They filed claim with the Industrial Accident Board, and appealed from the ruling of the Board by filing suit in one of the district courts of Wichita County. Upon the first trial judgment was rendered denying recovery to all of the brothers and one of the sisters, on the ground that they were not dependents of the deceased employee.
