J. PERTINENT PROCEDURAL BACKGROUND

On September 26, 2003, this Court entered a Memorandum of Decision and Order granting Plaintiffs Motion for Summary Judgment. See docs. # 44 and # 45. Since the Defendant did not file a timely response to the Plaintiffs Motion, the Court treated the summary judgment motion as unopposed, accepted as true the Plaintiffs Statement of Undisputed Facts and granted judgment in favor of the Plaintiff.
