Pending before the court is Defendant Vanessa Jiménez Cuevas’ Rule 12(b)(6) Motion to Dismiss the Complaint (“motion to dismiss”), Docket No. 10, and plaintiffs opposition, Docket No. 17. For the reasons set forth below, the motion to dismiss filed by defendant Vanessa Jiménez Cuevas (“Jiménez”), is GRANTED.
