This case has come before the court upon the defendants’ motion to dismiss, or in the alternative, motion for partial summary judgment. The plaintiff is a tenured professor at Duke University Medical Center (DUMC). He alleges that defendants Duke University and DUMC violated the Age Discrimination in Employment Act of 1967, 29 U.S.C. § 621 et seq. (ADEA).
