DAMICH, Chief Judge.

I. Introduction

Before the Court is Defendant’s Motion to Dismiss (hereinafter “Def.’s Mot.”). Defendant seeks dismissal of five claims asserted by the Samish Indian Nation (Plaintiff). Claims one and two allege that Defendant should have treated Plaintiff as a federally recognized tribe during the period of 1969 to 1996. Claims three and four allege that Defendant violated the promises made to Plaintiff in the Treaty of Point Elliott during the period of 1969 to 1996.
