This case is on remand from the Supreme Court for reconsideration in light of State v. Rhodes, 315 Or 191, 843 P2d 927 (1992). Defendant was convicted of delivery and possession of a controlled substance, ORS 475.992, and for driving under the influence of intoxicants (DUII), ORS 813.010. In our opinion, 100 Or App 256, 785 P2d 801 (1990), we held that the trial court improperly denied defendant’s motion to suppress all evidence obtained as a result of a search.
