OPINION AND ORDER

LEVAL, District Judge.

Third-party defendants, W. Austin Bar-salou and Barsalou & Associates, P.C. (collectively “Barsalou”) move, pursuant to Fed.R.Civ.P. Rule 56, for partial summary judgment dismissing the first, second and third causes of action in third-party plaintiff Rockwood Insurance Company’s (“Rockwood”) amended third-party complaint.
