O’QUINN, Justice.
This suit originated in the county court of Montgomery county, Tex. D. D. Keen died in said county on March 25, 1933, and A. L. Johnson was appointed administrator of his estate. June 3, 1933, appellant filed her petition in the estate of D. D. Keen, claiming that she was the wife of the deceased, and that she was entitled to an allowance out of said estate of $1,000 per year for the maintenance of herself and minor child. Appel-lees? W. M.
