The plaintiffs, Henderson and Stan fill, brought an action in the Poinsett circuit court to recover damages for injuries alleged to have been occasioned by the joint and concurrent negligence of defendant company and N. B. Pyle and A. M. Lambertus, engineer and fireman in charge of the operation of a locomotive, tender and water-tank attached, the property of said company.
