FORMAN, District Judge.

The defendant, Metropolitan Life Insurance Company, on March 14, 1944 issued a policy of life insurance in the amount of $5,000 upon the life of Harry Garmau, who died November 21,' 1945. Upon failure of the defendant to pay the claim, Anne Gar-man, wife of the insured and benficiary in the policy, instituted a suit on it in the New Jersey Supreme Court, which afterwards was removed to this court.
